They said HIS assistant because they knew Orochimaru created that Jutsu. When they mean HIS, they mean Orochimaru. They wouldn't be thinking of Tobi. That would be fucking stupid, because Tobi did not create that jutsu. Let me explain it differently.
John created the sandwich. John taught Jesus how to make a sandwich. John dies. Joe, Johns bff4lyf, comes over to him and asks him if he can borrow his bike. Jesus then makes his friend Jack & Jorge a sandwich, and sends it to them telepathically. They know that John created the sandwich, but he is dead, and Jesus sent talked to Jack telepathically telling him to enjoy his sandwich. It would make no sense for them to say "Oh, this must be HIS (Joe's) assistant!
I'm sure that has many plot holes and was not a correct analogy, but I hope you realize they were not talking about Tobi.
